MAINTENANCE ALLOWED
WIFE TO HAVE £3 WEEKLY DECISION OF THE JUDGE Decision was given by Mr. Justice Callan in the Supreme Court yesterday on the application of Mary Frances Schischka (Mr. Haigh) for permanent maintenance from Rudolph Burn Schischka (Dr. McElroy). "My conclusion," said His Honor, " is that an allowance of £3 a week is possible, having regard to the husband's ability, and is necessary having regard to the wife's needs." His Honor made an order accordingly and fixed the wife's costs at £lO 10s. Mrs. Schischka had been respondent in a divorce suit in which her husband succeeded, and she asked the Court to fix maintenance at £3 10s, which was the amount previously fixed by separation- agreement between the parties. Schischka asserted that he was not able to pay anything at present. His decre absolute was pronounced on December 16 last and he remarried on December 18. His Honor said that the sole issue in the case was the measure of the husband's capacity to pay.
