TOHEROAS TAKEN
SEQUEL IN THE COURT HONORARY INSPECTOR FINED " This man was an honorary inspector of fisheries," said Mr. K. Meredith, prosecuting on behalf of the Marine Department in the Police Court yesterday, when Henry Cecil Wheeler, of Waiinauku, was charged on summons with two breaches of the fisheries Act. It was alleged that oil July 21 defendant took more than 50 toheroas at Muriwai, and had in his possession toheroas, the shells of which were less than 3in. in length. Captain Charles Daniels, seniorinspector of fisheries at Auckland, said he saw defendant at Muriwai, and he had in his possession nine sacks* of toheroas, some of which were under the regulation length. When questioned, defendant said lie had received instructions to use his discretion in the matter of toheroas, and intended giving them to the unemployed. Evidence was given by Albert Ernest Hefford, chief inspector of fisheries, that no instructions such as defendant had stated had been given. In reply to the magistrate, Mr. F. K. Hunt, Mr. Meredith said that defendant was a farmer, and also a justice of the peace. The magistrate imposed a fine of £2, with costs.
