MILK COMPANY CASE
COSTS ON COUNTER-CLAIM SUPPLEMENTARY JUDGMENT A supplementary judgment in tho case of the Auckland INI ilk Company, Limited, against William Percival Levy, trading as the Farmers' and Vendors' Association, was delivered by Mr. Justice Ostler in tho Supreme Court on Saturday.
His Honor, who had previously decreed that plaintiff company should succeed in its claim for £650, and that defendant should succeed in part in his counter-claim, stated in the supplementary judgment that he would allow defendant £3O as costs of the counterclaim to be deducted from tho costs of the claim. His Honor said it had been necessary for defendant to file his counter-claim, to prepare for trial, and to fight the case, for the items in which he had succeeded were not admitted by tho plaintiff company until after tho hearing had commenced. The lump sum awarded covered tho scale costs for tho issue and service of the counter-claim, preparing for trial, hearing, and a reasonable allowance for the necessary witnesses to establish that part, of the counter-claim on which defendant had succeeded.
