SHARE IN HUSBAND'S ESTATE COURT RESERVES DECISION [BY TELEGRAPH —PRESS ASSOCIATION] WELLINGTON, Wednesday The Full Court this afternoon considered an application by Mary Teresa Donohue, of Liverpool, England, for relief under the Family Protection Act, 1908, against the Public Trustee as executor of the will of her late husband. The application came on for hearing at Auckland last month. The claimant stated that in 1901 in England she was married to her late husband but that in 1908 she was deserted by him and left with the t\vo children of the marriage to maintain. Early in 1931 she was informed that her husband had died three years previously, leaving all. his property to friends. She immediately applied for relief under the Family Protection Act. Mr. Justice Smith was of the opinion that legal authority was against het- application on the ground of lapse of time. As the applicant had not the money to prosecute an appeal he referred the question for the opinion of the Full Court. Written argument was submitted on behalf of the applicant. Counsel for the Public Trustee opposed the application on the ground that the lapse of time was too great. The Court reserved its decision.
