FUR COAT PURCHASE

COURT AWARDS DAMAGES

SHIFTING OF RESPONSIBILITY

LONDON, Nov. 17

Miss Elizabeth Evans, a waitress, of Walworth, secured £l2O damages from L. Hamper, a costumier, in the King's Bench Division in connection with a fur coat which she bought for 87s. After wearing the coat spots developed on her face and neck, resulting in disfigurement and preventing her from going out for some months. The diagnosis was dermatitis, due to the fur.Hamper testified that the coat was sold as it was received from Harris Rappaport, a fur dealer, who was cited as a third party.

Rappaport said that he obtained the skins from L. de Vos, of Belgium, and made the coats without further treatment. Vos was cited as fourth party. Rappaport said that ho understood that the furs were Australian rabbit skins and underwent treatment in Belgium, completely altering their appearance.

The Court held that there was a breach of warranty, but that there was no negligence on the part of Hamper, who was given judgment against Rappaport, who, in turn, was given judgment against Vos.
