CHARGE OF UTTERING.
CASH GIVEN FOR CHEQUE. YOUNG MAN SENT FOR TRIAL. A charge of uttering a cheque for £22 10s to a firm in Otahuhu on June 4 was preferred against Sidney Gordon Ross, aged 19, before Messrs. R. B. Todd arid C. R. Petrie, J.P.'s, in the Otahuhu Police Court yesterday.
Frederick J. Andrew, manager of the firm of Andrew and Andrew, general merchants, Otahuhu, stated that accused called at the firm's premises and presented a cheque drawn in favour of James Wilson for £22 10s. Accused stated that Charles Ross owed the firm £ll 7s 9d for tyres and he had called to pay this amount. Accused said ho had five weeks' wages due to him and would take the balance of the cheque in cash. The cheque was purported to be drawn by C. Ross in favour of James Wilson. Witness took accused into tho office and instructed the firm's accountant to accept payment and pay accused the £ll 2s 3d balance in cash. About June 17 witness called on Charles Ross at Onehunga and asked if he had drawn a cheque for £22 10s in payment of the account. He said ho had not don® so. The cheque was later returned from the bank.
Edward V. Daldy, manager of the Bank of New Zealand at Huntly, said the cheque produced was one from a book of cheques issued to a firm, Charles Ross, Limited, on April 9, 1931, when the firm was trading at Pukemiro. This firm had an account which had been closed for some considerable time. , Charles Richard Ross said accused lived with him, and the cheque book from which tlio cheque had been taken was kept at witness' home. Witness did not know anyone by the name of James Wilson, arid the signature on the cheque was not his. Detective McWhirter stated he interviewed accused on July 5, when he denied the allegations, stating ho was at homo all day playing cards on June 4. Accused pleaded not guilty nnd was committed to the Supremo Court for trial.' He was granted bail in two sureties of £IOO.
