CAPTURED IN SHOP.
BREAKING AND ENTERING. A LABOURER CONVICTED. JURY RECOMMENDS MERCY. Arising out of an incident, at. Newmarket. on the evening of March 12,, Thomas Frank Carey, a labourer,- aged 41 (Mr. Allan Moody), had to answer thrco charges in the Supreme Court yesterday. He was charged with breaking and entering the chemist's shop of David Teed, Limited, in Broadway, Newmarket, with stealing money from it and with being a rogue and a vagabond in that he had been found there by night without lawful excuse. Tho Crown Prosecufor, Mr. V. R. Meredith, said the case would give tho jury no difficulty. Three young men had watched the accused from across tho street shaking at the door of tho shop and finally breaking into it, and they afterwards assisted a constable to capture him on the premises. Evidence that he had seen (he accused pulling tho lock off the door of tho shop with a bag hook, was given by Geoffrey Speakman. When the accused went into tho shop through tho door witness summoned Constable Hendren .and two others. Carey behaved very violently in the shop, almost like a madman. There was a strong smell of liquor on him. Similar evidence was given by Vif'o' Baker and Albert R. Beli. Baker stated that Carey attacked the constable with a bag hook. Constable Hendren, who made the arrest, said that Carey was perfectly sober. He struck at witness with a bag hook. Mr. Moody said the antics of tho accused od the night in question showed that ho was either a madman or completely under tho influence of drink. Tho accused could not givo evidence as ho had no recollection of what took place. Several waterside workers gave evidence that accused had been very excited and "silly drunk" on the flight of March 12. Mr. Justice Hcrdman (old the jury that generally speaking drunkenness was no defence for crime. It could scarcely bo said that this man was out of his senses and incapable of forming an intention, as the evidenco indicated quite the contrary. The jury found accused guilty of breaking and entering with intent to commit a crime, and added a strong recommendation to mercy on account of his previous good character. Accused was remanded until next Wednesday for sentence.
