MINIATURE GOLF COURSE.
SUNDAY OPENING CHARGE. DISMISSAL BY MAGISTRATE. In a reserved decision given in the Police Court on Saturday by Mr. W. H. Woodward, S.M., three informations against Maurice S. O'Connor, who was charged with keeping open his miniature golf course at Cheltenham Beach on Sundays for the purpose of transacting business, were dismissed. In giving his decision, the magistrate held that the circumstances were entirely different from those of a previous case in which the discrepancy between the cost of drinks on Sundays and on weekdays showed that the increase on Sundays was a payment for a game. The discrimination made in the price of drinks for children,'presumably non-players, was another factor which led to his decision.
In the present case, however, the magistrate said he could see no such discrimination. ' The charge for drinks at all times and in all circumstances was Is and therefore the charge for drinks could not be held to have been a payment for a game of miniature golf.
