Evidence was given that early this morning the accused was seen l>v a roadman at Whatawhata, walking along the bank of a stream without his clothes. Tho temperature was below freezing point. Accused's brother said Reti went for a swim regularly and usually wore a costume. Senior-Sergeant Sweeney said thero was a dense fog at the time. The magistrate said that would bo a factor in mitigation of the offence. Tho accused was convicted and discharged. \
