NEIGHBOURS' DISPUTE.
ALLEGATION OF ASSAULT. SETTLEMENT OUT OF COURT. A neighbour's quarrel was ventilated in the Police Court yesterday morning when Albert Percival (Mr. Sullivan), was charged with assaulting Oswald Archibald »Prior (Mr. Hart), upon whose complaint the information was laid. Prior stated that as he was returning home one evening his neighbour Percival spoke to him about some water which was draining from Prior's property on to that of defendant. Witness had replied that it was impossible for him to stop it and he had then been assaulted by defendant.
Mr. Sullivan said the case arose out of a squabble between neighbours and it was a pity the matter had been brought before the Court, as the imposition of punishment on either party would only leave,a sting that would rankle. Mr. Hart said his client .was prepared to withdraw the complaint if defendant would make a settlement out of Court and pav him damages. ' Mr. Sullivan said his client would not agree to the payment of damages. After further evidence had been called by the complainant Mr. Sullivan said he could not hope to discount the evidence of the assault and his client had instructed him to agree to Mr. Hart's suggestion. The case was then withdrawn on defendant agreeing to pay damages to complainant amounting to £2.
