LEASE OF A PROPERTY.
V CLAIM MADE FOR £167.

The Thames Magistrate's Court was engaged for nine hours yesterday and to-day in hearing a claim by A. E. Palmer, farmer, of Auckland (Mr, C. J. Garland), against L. S. James, farmer, of Ngatea (Mr. E. L. Walton), for the recovery of £167.
The plaintiff said that in August, 1925, he leased his 33-acre farm at Kerepeehi to defendant, who covenanted to maintain the buildings, drains and fences and to improve the fertility and abundance of the soil. The claim included £45 for alleged neglect to cleatdrains, £67 for failure to repair fences, and £45 for the cost of discing and sowing 20 acres.
Defendant, who had paid £34 into Court, claimed that he had really, by virtue of earnest endeavour, enhanced the value of the farm by adding to the buildings and observing the clauses of tho lease. He valued the Farm at £33 •an acre. Under cross-examination ho admitted that lie was paying a rent'of six per cent, on a valuation of £BO an - acre. Decision was reserved.
