GRAND JURY DISAGREES.
DISCHARGE OF ACCUSED. CROSSING FATALITY SEQUEL. [DY TIXEGHU'II.—nU N r ORUESPOXPEXT. ] HAMILTON, Tuesday. An unprecedented position arose in (lie Hamilton Supreme Court to day in a case in which a Ifinuera farmer, Andrew Ernest Ilandrup, was charged with driving a motor-car negligently and causing the death of a Maori woman, Toi Rawhiri, and her infant daughter. The charge arose out of a motor collision between a car accused was driving over .a railway crossing at Matimnta on August 11 and a special train returning with tho employees of mi Auckland firm from n picnic at ,\rapuni.
When the grand jury was empanelled one. member was excused and two others failed to appear. The charge against Randrup was therefore submitted to a grand jury of 21 members. Just before the luncheon adjournment, the foreman. that the grand jury was unable to agree whether a true bill or a no bill should bo found. His Honor said at least twelve members should agree before a true bill could be returned. After a four-hour retirement the grand jury again advised llio Judge Hint it was unable to agree. His.Honor said in that case a no bill must bo .returned. He therefore discharged the accused.
