APPEAL FROM DECISION. An appeal from a decision in the plaintiff's favour ? given in the Magistrate's Court by Mr. F. K. Hunt, S.M., '.was heard in the Supreme Court yesterday before the Chief Justice, Sir Robert Stout. \ The appellant was F. G. Russell, farmer, Morrinsville (Mr. McGregor), ;de'feM?nt in tho former action, and the respondent was J. B. MacEwan and Co., Ltd. >(Mr, Teary). In tho Magistrate's Court action, MacEwan/ Ltd., claimed 'for £9B, balance due on a milking plant and for repairs, while Russell counterclaimed for £l5O, it being contended ithat the ijihe .was defective. The appeal Svas confinid to the original counterclaim. Counsel for the appellant argued that the decision was wrong in fact and in law. He referred to the history of the itrouble with tho engine, and claimed ithat tho appellant was entitled to some damages. . For the respondent, it was denied there ■Was any defect, Intent or otherwise, in the engine as originally supplied. Decision was reserved.
