MOTOR ACCIDENT SEQUEL.
LORRY "CUTS THE CORNER."
Reserved judgment was delivered by Mr. E. C. Cutten, S.M-. yesterday in a case in ■which T. M. Finlayson (Mr. Inder) claimed £57 17s 30d from Hartley's, Ltd. (Mr. Butler), for damages sustained by a motor-car in collision with a lorry driven by an employee of defendant.
Plaintiff's statement of claim set out that his car, driven by his wife, was turning from Park Avenue into Park Road ■when it was struck by the lorry, which was alleged to have been driven negligently. Defendants counter-claimed for £4 10.5 damages.
In delivering judgment Mr. Cutten taid: "I am satisfied the accident was caused by defendants' lorry cutting the corner at, a speed at which a collision could not be avoided. The daiaage to tho -vehicles is consistent with the explanation that they were nearly at right angles at the moment of impact. The collision apparently took place before plaintiff's car had turned far into Park Road, and defendants' driver avoided a more serious impact by turning sharply away in a manner which successfully * took the front of the lorry out of the" way of the motorcar. ''
Judgment was for plaintiff for the amount claimed, with costs. On the counter-claim defendant was awarded £2 2s costs.
