A NEWMARKET DISPUTE
The subdivision of a Newmarket properly was the subject, of an action heard | by Mr. Justice Stringer in the Supreme
j Court yesterday. Leopold August Mal- | littc (Mr. Quart ley) sought to recover £52 from Mary Ann Mclntyre (Mr. Terry) as damagesc arising out oi alleged trespass or alternatively, for mesme profits, in respect, of a verandah and lean-to which was on plaintiff's land in Manukau Road. j Plaintiff bought the property from a Mrs. j Mill, who had acquired it from defendant, I and the frontage was given as 55ft. Gin. i Defendant owned the adjoining section. j The dividing fence did not correspond with I the title deeds. It was for the use of these by defendant or her tenant that plaintiff claimed. After taking evidence and hearing legal argument, His Honor reserved his decision.
