ACTION AGAINST BANK.
NEWSPAPER'S . COMMENT.
CONTEMPT OF 1 COURT SUIT.
FAILURE OF APPLICATION.
By Telegraph— Association—Copyright (Received 7.55 p.m.) A. arid N.Z. LONDON, May 15. An unsuccessful application was made before the King's Bench division for. a rule nisi for alleged contempt of Court against the Daily Mail. This was a sequel to certain information published by the paper named concerning an approaching action, Charles Robinson versus the Midland Bank, a claim for £125,000.
Lord Halsbury, who appeared for the applicant, declared that behind the pending case there was a sinister, wicked and criminal conspiracy. He ''said that a person in a high position was connected with the case.
In referring to Mr. Robinson's claim, the newspaper referred to a cheque for £150,000 drawn by an Indian Rajah in favour of the claimant. 'Die article also mentioned Mr. Robinson's allegation that the money was drawn out of the bank by means of forged cheques. Lord Halsbury declared that the term "Rajah" was inaccurate. The case would certainly be the most amazing ever heard before the Court.
Continuing, Lord Halsbury said that after the pleadings had closed, the bank had added a charge of the grossest fraud against the claimant, suggesting that he was one of the conspirators. The Bench held that it had not been shown that the article was calculated to prevent a fair trial, whatever might be said concerning the expediency or taste of such a publication.
