A BILL OF COSTS.
ORDER FOR TAXATION.
["BX TELEGRAPH. —OWN' CORKESPONDENT.] HAMILTON, Monday. An application was made before Mr. Justice llacGregor in the Hamilton Supreme Court on behalf of Herbert Allen Bunn, farmer, of Hillcrest (Mr. Tompkins),' for an order 'directing the registrar of the Supreme Court to tax a bill of costs delivered by R. M. Grant, solicitor, of Whakatane, to one Charles Tickner. The facts, as stated by counsel, were that Bunn had agreed to pay off a morteare at a discount, and had then promised to pay the costs incurred by Tickner with hie solicitor, Mr. Grant, in connection wish the negotiations. Bunn further alleged that the. agreement was subject to the costs being taxed. Mr. Tompkins said that -Grant had put the bill before a magistrate at Whakatane, and th© i magistrate had certified the charges to be reasonable. Bunn, however, had had no notice, and was not represented. Counsel contended therefore that Bunn could not be bound by this reference, and was entitled to a taxation. _ In opposing the application, Mr. lung contended that the bill of oosts had been certified to be reasonable, and that Bubn must therefore pay it. His Honor held that the reference to a magistrate was not a taxation and that Bunn was entitled to be heard. He therefore made an order for the taxation of the bill of costs. Costs were fixed at £3 3s.
