CONSTITUTION OF TRUST.
[BX TELEGRAPH. — PRESS ASSOCIATION.] KELSON, Monday. Representation has been made to the Government by Mr. H. Atmore, M.P., on behalf of the Nelson City Council, seeking a commission of inquiry into the circumstances of the 'founding and establishment of the Cawthron Institute, more particularly for the purpose of ascertaining whether the beneficiaries (the general public) have not been deprived of their right of electing trustees, per medium of the local bodies and the general election. A protest was made by the City Council, because the vacancy on the board caused by the death of Mr. C, J. Harley, who was Mayor of Nelson at the time he was appointed, was not filled by the present holder of that office, Mr, W, Lock. The trustees-replied that they had acted in consonance with a judgment obtained by them from the full Court in 1916, in which it was laid down that there was no succession, and the appointment had been made in accordance with the Trustees Act, 1968. Sir Francis Bell, in replying to a letter from Mr. Atmore, states that inquiry has shown that there is no right of succession, but that if he receives a joint request, from the local bodies concerned he will seriously consider the question of legislation in order to give effect to the late Mr. Cawthron's obvious intention that the trust should be composed of persons holding offices mentioned in the will.
