SHARE OF COMMISSION.
CLAIM BY AN AGENT. JUDGMENT FOR PLAINTIFF. Judgment was given in tho Magistrate's Court yesterday by Mr. B. C. Cutten, in a claim for a 45 per cent, share of land agent's commission by Eric Jansen (Mr. C. A. Snedden) from A. B. Proud (Mr. Dickson). The circumstances of the case were that defendant, a land agent, engaged tho plaintiff to work in his office on condition that he should bo paid 45 per cent, of the commission where sales were made through his efforts. This arrangement was also made with the other salesmen in the office. Before a sale»ovcr a Heme Bay property was completed, defendant terminated the arrangement with plaintiff, and gave plaintiff a week or ten days in which to bring about a sale of any property in his hands. After the expiry of the ten-day period the Heme Bay property was sold. . The plaintiff claimed 45 per cent, of the commission, while the defendant denied liability because the sale did not take place within the ten-day period. The magistrate said the fact the arrangement between the defendant and the plaintiff terminated as far as further business was concerned did not affect the plaintiff's rights with respect to work on which he had done all that was Required of him in order to entitle him to a share of commission. Judgment was for the plaintiff for £33 15s, with costs.
