TIMBER LAND DISPUTE.
THE WAIMIHA APPEAL. [BY TSLXQBAPH. —PRESS ASSOCIATION.]
WELLINGTON. Tuesday.
The Court of Appeal concluded hearing argument to-day in the case of tho Waimiha Sawmilling Company, Ltd., versus the Waione Timber Company, Ltd.
Mr. Johnston for the defendant stated that counsel for plaintiff had admitted in a previous case before the Court that Wilson had bought in faith. The fraud 011 his part was clearly therefore not obvious. Mr. Johnston also maintained that the original agreement between Howe and plaintiff was one of which the Court would not now enforce specific performance and therefore their claim in the present action could not be granted. Mr. Stanton, in support of the case for the defendant, said the defendant based his claim to the land on the judgment of Mr. Justice Sim, removing the caveat which prevented dealings with the defendant. The company nad the right to assume that the caveat was removed to enable the transfer to it to be registered. After Mr. Skerrett had replied the Court reserved its decision.
