SOLDIER TENANTS.
NO SPECIAL PROTECTION. APPEAL COURT DECISION. [BY XBUBGBAPH.—■MUSS ASSOCUTtOW.] WELLINGTON. ThursdaySoldier tenants are now in the same position as any other tenants in respect of all premises occupied by them, whether . as dwellings or ae shops. This was tha decision of Mr. Justice Salmond in giving judgment in the test casa, William Robinson (soldier tenant) v. Archibald Laurie (landlord), an appeal against the decision of Mr. F. SL Hunt, S.M. The case had to do with a combined shop and dwelling house. It was contended on the appellant's behalf /hat even though the special protection previously afforded soldier tenants in respect of dwellings might no longer exist, returned men or their dependants within the meaning of the Act still retained the special protection afforded by section 13 of the former Act, in respect of shops, notwithstanding the provisions of the new Act. After referring to the wording of several Acts and amendments. His Honor held that-if section 13 no longer conferred protection in respect of a dwalling house, it could not do sc in respect of a shop either.
