STATE GOVERNOR CHARGED.
JUDGE SANCTIONS ARREST.
Australian and N.Z. Cable Association. (Reed. 1.5 a.m.) NEW YORK. July 26. In connection with the indictment of Mr. Small, Governor of Illinois, on a charge of conspiring to defraud the State of 2,000,000 dollars and embezzling 700,000 dollars, the State Judge decided that Small must face arrest. He declared that there was no such thing as divine right "of kings, and there were no kings in Illinois. Therefore, the concept that the king can do no wrong, was baseless. It was beyond the scope of the Governor's power to call State troops to shield him from arrest. The Governor was subject to arrest and prosecution for his acts as State Treasurer. Mr. Small declared, upon the advice of counsel, that he would resist the warrant issued for his arrest. He based his contention upon the common lawdictum that %the King can do no wrong. Lawyers pointed out that each State considered itself sovereign, and the Governor its -supreme power, who could immediately pardon himself if convicted. Impeachment was the only method of removal.
