A HORSE DEAL.

Whether a horse was given or sold was the point at issue in the case in which the executors of Benjamin Armitage, deceased (Mr W. H. Grace) . claimed, from John Gordon (Mr. E. Mahoney), of Paeroa, to reoover the sum of £19, £18 the value of a brown horse and £1 freight. Evidence was given for the plaintiffs that the purchase was made in the usual way. It was stated that when the transaction took place the defendant asked for a mare for breeding purposes. Ho took" a "gelding which could do a little work. No mention was made of a gift. The defendant said that the horse was of little value, and that it was given to him as a gift' The magistrate, Mr. E. C. Gutten, said there was a principle involved in the case, and he would reserve his decision untii to-day.

Glaister), Auckland, against W. S. Harrold, of Avondale. and L Etherington, Gisborne (Mr. H. L. Simson). After evidence had been heard judgment was given for plaintiff for the full amount claimed, with £5 5s costs.
