MAGISTRATE'S COURT.

The value of bulbs came into consideration before Mr. C O. Kettle, S.M., at the Magistrate's Court yesterday, when Archibald Clements (Mr. J. H. Gregory) sued William Hamley (Mr. E. J. Prendergast) for a sum of £4 7s 4d. The sum of £3 was claimed for bulbs alleged to be taken up and removed by Hamley, who was a tenant of the plaintiff for some years. The balance of the sum claimed was made up as follows: — £1 for partial destruction of a fowlhouse, 3s for blind-rollers removed, 2s 6"d for gas globe removed, and lOd for a globo damaged. It was submitted that when defendant's tenancy expired' he left, taking with him the roof of the fowlhouse, two blind-rollers, and some bulbs. After hearing evidence, His Worship remarked that the case was such a trivial one that it was a pity it had ever been brought up. Ho gave judgment for £3, disallowing costs. r * • Herbert McLeod and , William Morgan, builders, of Auckland, sited Richard Stark, ' of Remuera, for £35 claimed on a building and labour contract for work done on a house erected by them for defendant. The sum of £7 10s was written down for the cost of construction of an extra base. " When shown the plans plaintiffs thought that the house was on a level section, and gave their price accordingly. They afterwards saw the site, and found that the building had to bo built on a slope, with about a 6ft base at tht back. The balance of the claim was made up of extras as follows:—Two rooms, £7; door and window, £1; . balcony, £3 10s; delay in supplying timber, £5; and construction of a landing, 103. Mr. N. P. Wyatt, who appeared for plaintiffs, said that plaintiffs had been put to these expenses, owing to the fact that the plans had been misleading, and that the materials had not come to hand as they should. Mr. A .G. Pilkington appeared for defendant, who made a general denial of the liabilities. There was also a sum of £10 unpaid on the contract price, and this was included in the claim.
