A SEAMAN'S OVERTIME. Reserved judgment was given by Mr, C. C. Kettle, S.M-, at the Magistrate's Court yesterday in the case in which James McTighe, an able seaman., claimed to recover 3s from the Northern Steamship Company. This sum represented the balance alleged to be. due for overtime at Is 6d per hour, the dispute really being whether overtime should be paid at the rate for sea-watching or at that for c 3-handling. The plaintiff was representee by Mr. A. E. Skelton, while Mr. M. McGregor appeared for the defendant company. '„.':•

In giving his decision, His Worship stated that the whole question was the construction to be put upon clause . 12. of the agreement. He was of opinion that the seaman was only entitled to receive overtime for th-e work he had done after the eight hours had expired. For such overtime, he should be paid according to the rate specified in the agreement for the particular class of work done. Judgment would be given for the defendants. .... FLY-INFECTED FRUIT. , A claim for £55, representing the value of fruit sold and delivered, was brought by W. H. Grove, fruit importer, of Auckland, against J. F. Shiels and /.■■.Co.; of Dunedin...,; The plaintiff was represented by Mr. Mahoney, while Mr. Singer appeared for the" defendants. The defendants had ordered the fruit from the plaintiff, but though apparently sound when shipped from Rarotonga,'the fruit, when it reached Dunedin, was found to be infected with the fruit maggot.
