COMPENSATION CLAIM ABANDONED.

DEFENDANTS ASK FOR COSTS.

[BY TELEGRAPH. — ASSOCIATION.] Wellington, Sunday. A novel point in compensation legislation came before His Honor the Chief Justice at the Supreme Court yesterday, when the Featherston County Council, represented by Sir John Findlay.* K.C., asked that a date he fixed tor the hearing of a claim for compensation by Donald Cooper Yule. Sir John Findlay said that on August 2, 1911, Yule claimed £1050 for damages alleged to have been caused by the Council's river .protective works. The Council was put to great expense in preparing to meet the claim, which plaintiff quite recently abandoned. They asked that a silting of the Compensation Court be held in order that defendants might recover their costs.

Mr. Alex. Gray, on behalf of plaintiff, opposed the application. He said that plaintiff could not, tell at once whether the works would cause injury to his land, but he had to file his claim, or else he would lose his right to, compensation. His Honor said he would consider the matter.
