[BY TELEGRAPH.—-PRESS ASSOCIATION.] Dunedinv Thursday. At the Supreme Court, before Mr. Justice Williams, in Banco, this afternoon, Mr. Irwin, on behalf of Duncan Muirhead, ( applied for a rule to make absolute the rule nisi for a' new trial in the divorce case, Muirhead v. Muirhead and Gaw, in which in November last, a petition by petitioner | for divorce from his wife, Elizabeth Jane Muirhead, on the' ground of misconduct with , Alex. Gaw, stationmaster, was dismissed. Mr. B. S. Irwin appeared for petitioner and Mr. Hanlon for co-respondent to show cause why this petition for a new trial should be dismissed. The ground set forth for the petition was that the November verdict was against the weight evidence'. • In giving his decision. His Honor said, It is not for me to say whether the parties were guilty or not guilty of adultery. 1 The jury has found that they were not, ! and I see no sufficient reason to disagree 1 with it. ' The rule will be-discharged 1 with costs (£7 75)." i
