LIABILITIES OF A COMMON CARRIER.
[AT TELEGRAPH.— OWN CORRESPONDENT.] Gisborne, Wednesday. Judgment was given by Mr. Barton, S.M., in the Magistrate's Court to-day in a ease involving the definition of the liabilities of a common carrier. The claim was for merchandise consigned to Turiroa, a few miles up the Wairoa River, by the Wairoa and Mohaka Syndicate's steamer. The goods were taken from Napier to Wairoa, and there landed and placed in store until they could be carried on up river to Turiroa. In the meantime the shed took fire, and the cargo was destroyed. Defendant claimed his liability as a common carrier was suspended whilst the goods were in the shed, he then acting merely in the capacity of a warehouseman, but the magistrate held that the goods were landed at Wairoa for the defendant's convenience, and there was nothing to relieve him from liability. Judgment was therefore given for the amount claimed, £23 9s 9d, and costs £4 2s.
