Kettle, S.M., gave judgment in the case in which Alexander Morton sued S. Holden Howie for £65 for five bicycles, handed by the plaintiff to the defendant for sale. The magistrate said the case was only one of facts, there being no question of law. He was satisfied the bicycles were used by defendant, or by people in his authority, in a manner not authorised by the plaintiff. Ho gave judgment for £14 Is and costs, defendant to keep the refuse of the bicycles. . ~ PLAINTIFFS NONSUITED. E. W. Whitehead and Son sued Charles A. Nadir for £12 12s for services rendered in valuing the furniture of a hotel in course of sale. After hearing some of the evidence, the plaintiff elected to take a nonsuit, with costs, Mr. Lundon appeared for the defendant, and Mr. Elliott for the plaintiffs: - . L. L. Levy sued D. Sutherland, billiardroom proprietor, for £3 15s, for services rendered as manager of the billiardroom. For the plaintiff, the evidence showed that he had looked after the defendant's billiardroom on race days. The arrangement was that he was to be paid 5s a day. The defendant admitted that the plaintiff had, in a friendly way, taken charge of his billiardroom on some ! occasions. He had been paid, however, all that was owing to him. He produced books showing entries of amounts paid to Levy. The magistrate nonsuited the plaintiff, with costs. The defendant intimated that he would not claim costs. " DAMAGE TO A HOUSE. Mary A. represented by Mr. J. O. Martin, sued A. 'Litherlahd for £2 7s, damage, • alleged to have been caused to a house the . defendant rented from the plaintiff. The "amount";also included rent, £1 lis 6d, which amount the defendant admitted he owed,' and tendered. The magistrate, after hearing evidence for both sides, gave judgment" for £2 la 6d. -
