DENTIST AND STUDENT.
ACTION FOR BREACH OF AGREEMENT. [by TELECJBirn.—OWN COEIIESPONCENX.] Duxedin, Monday. A curious action for breach of agreement was heard in the Magistrate's Court here this morning. A dental student named. -dam David Edgar sought to recover from Caas, 6 Burdett the sum of £5 for ..reach of agreement. Defendant's name is on the baronetcy roll as the holder of a distinction created by Charles 11., but it was as a aen tint that he came under the magistrate's notice. The facts as set forth liy plaintiff •are that, in April last, the defendant agreed to give the plaintiff tuition in she subjects , prescribed for the dental examination and was paid £5, for which he gave a receipt, the said subjects being stated as anatomy of the head and neck (bones, arteries, nerves, veins, muscles), surgery, physiology, materia inedjea, comparative anatomy, and metallurgy, and that after imparting a few lesson? on "bones," lie went to Ciaxistchurch, and thence t,» Palnierston North, leaving the student to grind up arteries, nerves, etc., •• as best he could. In a letter sent from Christchui-ch, defendant said that he was sorry he had to go away, and would leave it to Edgar whether he would prefer the return of the £5, or to be kept posted up with work and questions till over tip regulation work, The letter was produced in Court as an acknowledgement of liability, and as Edgar told the magistrate- that he elected to take a refund, and there was no dtienoe, His Worship gave judgment as prayed, with 21a 6d coste.
