AT the Magistrate's Court Mr. H. W. Northcroft, S.M., gave judgment in the case David Pretty v. Isaac Coates, ciaim £54 4s 6d, for cutting and carting 125 tons of flax, at 7s 6d per ton, carting fibre at 6s per ton. and coal for fiaxmill, at Tnuwhare. Mr. Dyer appeared for plaintiff and Mr. Bwarbrick for defendant. The case turned upon the question a* to whether plaintiff had a contract with Mr. Coates or whether ho was a subcontractor. Mr. Northcroft, in giving judgment, said the onus of proving the contract fell on the plaintiff; this he had failed to do. Nonsuited with cost, £7 8s 2d. The case Delicar v. Thomas, claim £15, damage done to property by lire, was adjourned till next Court day.
