Sanford and Sons: In this case plaintiffs, who are fruit - merchants, claimed of defendant £48 for al- v leged wrongful conversion of 64 crates of , j oranges, tho property of Mr. V. K. Baumo appeared for plaintiff, and Mr. C. J. Parr for defendant. Joseph A. Messenger deposed to purchasng 64 crates of oranges from W. H. Grove, but when tho order for delivery was presented, the clerk * informed him that he was too late, as Mr. Sanford was taking them away. Witness afterwards offered to sell tho fruit to defendant for £48. To Mr. Parr: Tho wholesale price paid by him for the fruit on tho steamer was £32. William H. Grovo said that ho sold a special shipment of 64 crates of oranges to plaintiffs, and handed oVcijjthe bill of lading to Mr. Messenger. Witness also offered tho fruit for ealo to Mr, Ivrorifeld and Mr. Sanford. For tho defendant Mr. Parr contended that tho proper remedy for plaintiff to tako was an action against the seller for non-delivery. Tho plaintiff had sought to set up a salo botwoon Grove and himself, but defendant would givo evidence to show that he himself bought tho goods from Grove. He argued that if ''2lio dofendant mado the second transaction in good faith, ho should bo protected. Dofendant in ovideuco said that ho bought tho oranges conditionally on their -passing Uio inspector. Evidence was also given by Gustav Kronfeld, who stated that ho received an offer of a line of oranges from Grove, who said that if be did not accept them either Sanford or Messenger would buy them. Argument on both sides was hoard, and His Worship reserved judgment until the following day. ONEHUNGA POLICE COURT. Thursday. (Before Mr. T. Hutchison, S.M.) Fireworks: Walte. Plowman, a boy 1$ years of age. was charged with letting off crackers in Queen-street, Oneluinga, on October 7 last. The boy pleaded guilty, and was discharged, on promising not to repeat the offence. Prohibition Order: Mary Ann Dempsoy applied for a prohibition ordor against her husband, John Frederick Dcmpsey. Hickey, defendant, charged that ho did wantonly and maliciously damage certain property of the plaintiff by persistently filling in a dram dug by tho plaintiff when requested not to do so.
