IMPORTANT TO FORWARDING AGENTS.
[BY TELEGRAPH. —PRESS ASSOCIATION.] Wkllinqton, Thursday. A case of some interest to forwarding agents was decided by the Magistrate this afternoon. A firm of drapers at Greyunouth sued a firm of forwarding agents of this city fora sum of £3 10a in respect of certain damage alleged to have been done to a box of kid gloves, which, on itij arrival from home, was forwarded to Greymouth by the defendant. The plaintiff's statement set out that in the month of November last the box in question arrived, from home, and defendant wrongfully took possession of it, and passed tho Customs entries, and in consequence of the case being opened the goods were damaged. It appeared that the defendant received instructions from the plaintiff to receive this parcel and forward it. It was received, and defendant in the ordinary course passed the Customs entries for it, which necessitated the airtight box being opened, and on its way to Greymouth, being exposed to sea air, the damage was caused. It was contended that the instructions were nob to pass the entries, but to forward the parcel in bond. Mr. Skerrett, for the plaintiffs, said the latter was bound by his instructions, and not by any recognised custom. His Worship took this view of the caae, and gave judgment for i)s, nominal damage, with £2 3s (id costs.
