Public Notices. That the Company shall, subject to the performance of the restrictions, conditions, and regulations herein and in the said Deed of Assent and Agreement contained, have the exclusive right to > run cars along the course and within the lines now ' granted. And I do hereby order and direct its follows (1) That the said tramway shall be used for passenger and goods traffic, and that the tolls and charges mentioned in the ia schedule hereto, and such tolls and charges 16 as shall be jointly fixed by the Company ' n and the said Boards or by a majority ™ of them, where the toll® and charges id mentioned in the said Schedule hereto shall not apply, shall, subject to the proid visions of the said Deed of Assent and »r Agreement, and for the period therein h mentioned, be chargeable for the use of w the said tramway, subject to the regulasr tions in that behalf in the said schedule :>f contained. Provided always that from in and after the thirtieth day of March, one 11 thousand nine hundred ami five, the scale it of tolls and charges shall be revised and i- tixed by the said Boards and the Company, le or a majority of them, which majority s- shall consist of one of the Boards and the n said Company, and a reduction made s- therein of not lesis than one-third of the amounts fixed in the scale provided in and . by tho said schedule hereto. (7) That nothing in this Order shall prevent the said Boards, respectively or jointly, from making from time to time any regulations or by-laws which they as local authorities are empowered to make by Section 47 of the said Tramways Act. 1 (5) That in case the Company shall at any time s hereafter tail or neglect to observe, per- « form, or keep ail or singular the condi--1 tions, requirements, and provisions of tho 1 said Tramways Act, or any other Act for e the time being in force relating to tram--1 ways, and of this Order to the full intent of the same, or any part thereof, or to 1 observe any by-laws, rules, or regulations 1 which may from time to time bo made or • passed under or by virtue of the provisions of the Tramways Act, 1572, or any other > Act or Acts for the time beinp; in force 1 relating to tramways, then in audition to 1 the imposition of the penalties hereinbefore referred to, it shall be lawful for the Governor for the time being of tho | Colony of New Zealand by Order-in-Coun- ' cil to revoke and annul this Order, and tho • rights, powers, and privileges hereby '• granted. ) And I do hereby further direct that sections 30 to . 41, both inclusive of tho Tramways Act, 1872, shall apply to the tramway hereby authorised to bo con- [ structed ; and Ido further order and direct that ,- Parts 11. and 111. of Tramways Act, 1572, shall bo ! 1 deemed to be incorporated with the Order hereby made. And lastly I, the said Governor, do hereby order I ! and declare that nothing herein contained > shall be deemed in any way to interfere [ with, affect, or abridge any rich or powers that may be vested in Her Majesty . the or in the Governor on her j behalt, or otherwise, under any Acts of the General Assembly authorising the con- [ struction of railways or tramways, or the ( erection or construction of any other pub- [ lie work which hfr said Majesty, or tho i Governor on her behalf or otherwise, may 1 be authorised to meet or construct. SCHEDULE. [ Maximum scale of tolls and charges which may be [ demanded and taken by tho Company in respect of the said tramway. 1 PASSENGERS. Between the hours of 7.30 a..m. and i 7.30 p.m., both inclusive, for each passenger for the whole or any i part, of the said route .. .. Threepence. Between the hours of 7.30 p.m. and ; 7.30 a.m., for each passenger .. Sixpencei ! Children under three years of age in charge of adults to be carried true of charge. Children under 12 years of age, ha fare. Passengers' ordinary luggage to the : ox tent of 14lbs in weight .. .. Free. : All luggage over that weight may be charged at the rates herein fixed for small parcels. GOODS A.ND MERCHANDISE. SMALL PARCELS. For any parcel not exceeding 28) bs | in weight Sixpence. For every parcel exceeding 2Slbs in 1 weight, and not exceeding Mlbs in 1 weight Ninepence. For parcels exceeding 561 bs in weight, ; but not exceeding lOOibs in weight One Shilling. For parcels exceeding lOOlbs in weight, but not exceeding 2001bs in weight ... Two Shillings. Provided that the Company shall i have the option 01" refusing to carry any parcel or package exceeding stilbs in .weight, and are prohibited from carrying in any passenger car any parcel or package exceeding 1121bs in weight. All packages exceeding 2001 in 1 weight chargeable at discretion of Company. .
