Third Schedule to the said Act, in connection with »uch intended application, were duly deposited by the said Company in accordance with the regulations in such lastmentioued part of the said Schedule contained : And whereAa on nuking the said application pursuant to such notice, the said Company did on the £ouh day of December, 1887, memorialise me, the undersigned, William Francis Drummund Jervois, the Governor of the Colony of New Zealand, for an Order for the construction of the Tramway in the said notice mentioned, and did also deposit with ms die several other documents, and do and perform the acts and things specified in Part 3 of the said Third Schedule to the said Act, according to the Regulations ui such lasuueiitioncd part ui the said Schedule contained : And whereas it is deemed expedient that such order should be made: And whereas in the said notice so published as aforesaid, it was notified that the Company intended to apply for an Oruer authorising them to construct a Tramway within the Road Districts of Remuera, Epsom, and One Tree Hill, but it has since been ascertained that no portion of the said Manukau Road is now vested in the Road Board of the Remuera Road District, and that therefore the consent of such lastmentioned Road Board to the said Order is unnecessary : And whereas the Inhabitants of the Epsom Road District, and the Inhabitants of the One Tree Hill Road Districts, hereinafter called the said Boards, did by consent and agreement made and entered into with, and subject to my approval, dated the firth day of September, lfcSS, and made between the lnhauit-'auto of the Epsom Road District of the first part, tne inhabitants 01 the one Tree Hill Road District of the second part, and the Company of the third part, duly consent to the application contained in the saiil memorial, and did grant and agree unto and wit a the Company and its assigns full and free liberty for the term ui thirty years to carry out and complete the undertaking In manner prescribed by this order m that behalf, such term 01 thirty years to commence from the date of this Order : And whereas i have approved of such lastmentioned deed of consent and agreement : Now therefore 1, the undersigned, William Francis _ Drunimond Jervois, the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority in that behalf vested hi me by the Tramwavs Act, 1572, and the Abolition of Provinces Act, 1575, and of any and every other power and authority enabling me in that bahalf, and all things required" by the said Tramways Act having been done, do hereby, subject to the provisions of the said '1 ways Act, make, order, authorise, and empower the said Company to construct, make, and use a tramway for a period of thirty years from the date of this Order, within the limits of the said Epsom ana One Tree Hill Road Districts, along the course or route hereinaJter mentioned, of the gauge hereinafter mentioned, and subject to the restrictions, conditions, and regulations hereinafter contained, that is to say : — I.—That the course or route of the said proposed tramway shall be as follows, that is to say : — From the present terminus of the said Company's tramway at ewiuarket, along that course on the East fide of the Manukau Road to Green Lane, and upon f ucn levels (subject to Clause 6 hereafter) as shown on the plans marked P.W.D. 15730 and 15731 deposited in accordance with the provisions of Section 7 of the aid Tramways Act. 2.—That the gauge of the said proposed tramway shall be 4ft Sjii), a.nd the rails thereof shall be laid in a pi jper and effectual manner, on punri sleepers ballasted with scoria, so as not to interfere 111 anyway with the public traffic on the said road along the said course on the East side oi the said Manukau Road, and such tramway shall consist of a single line, unless the said District Boards shall approve of a double line. 3.—The rails to be used in the construction of the said tramway shall be either ordinary iron railway raile, Vignole type, weight at least 40lbs to the yard, or of such other pattern and weight as shall" have been submitted to and approved by the Governor. 4.—lf at any time the -Minister lor Public Works for the time being is of opinion that in consequence of increased traffic or population, or otherwise, the maintenance of the public safety demands the use of proper tram rails on the said tramway, or the fixing of guard-balks alongside the rails used on the said tramway, the Company shall, on receiving notice m writing to that effect, signed by the said Minister for Public Works, forthwith provide and lay such rails or jniard-balks in such manner and to such extent as the said Minister may require. s.—The rails of the tramway shall be laid, and shall be kept on a level with the surface of the road through or over which the said tramway shall pass as fixed from time to time by the local authority having control of the road, so that at all times ordinary vehicles can cross the same with ease and safety. 6.—Each carriage and car shall be fitted with complete and efficient brake gear, the details of which shall be submitted to and approved by the Engineer-in-Chief of the Colony, and the whole of the rolling stock to be used on the said tramway shall, before the same is allowed to be used for public traffic thereon, also be approved by the Engineer-in-Chief of the Colony, or some other person to be from time to time appointed by him for that purpose. 7.—Proper passing or crossing places shall be constructed by the Company where necessary along the line of the said proposed tramway for the purooses oi such tramway, and so as to subserve ana in no way interfere with the public convenience or the public traffic on the said road. That the said tramway shall be worked bv animal power, or by the best approved mechanical or other power, other than by travelling steam motor, as shall have been submitted to and approved by the Governor. • 9.The construction of the said tramway shall be fully completed and the said tramway shall be open for public traffic within six months from the date of this Order. Provided that nothing herein contained shall be deemed to prescribe any limit for the construction of passing places as herein authorised. That if the tramway is not completed and open for public traffic within the time mentioned in the preceding paragraph of this Order for the completion of the same, all the powers, rights, and privileges granted to the Company by this Order, of making and using such tramway, shall utterly lapse and be of none effect. 11.—The Company shall, so soon as the tramway shall be opened for public traffic, run cars thereon daily, except as hereinafter provided, commencing not later than half-past seven in the morning, and ceasing not, earlier than half-past seven in the evening. Provided that the Company shall not run any cars on Sundays, except and only so long as the said Company shall have and hold the authority and consent of the Councils of the Boroughs of the City of Auckland and Newmarket to'run cars through their boroughs respectively on Sundays. 1112.—A train for goods and passengers shall be despatched from each end, that is to say, the Newmarket end and the Green Lane end of the said tramway, every thirty minutes during each day between the hours of half-past seven a.m. and halfpast seven p.m., the first of such cars starting from the Epsom Terminus not later than half-past seven a.m„ and from Newmarket not later than a quarterpast eight a.m. 13.— cars despatched from the terminus between sunset and sunrise shall be provided with proper and efficient lamps affixed on conspicuous positions on the fronts and on the backs of each car, the lamps 011 the front being of a different colour to those 011 the back of the car, so as to indicate whether the car is approaching or receding, and the said Company shall be responsible for the said lamps being kept properly lighted and trimmed. 14.—The said Company snail also cause to be placed and kept inside every passenger car in every train despatched from a terminus between sunset and sunrise a lamp properly lighted, in such a position as shall be calculated to throw a good and proper light into every part of the said car, and tile saia Company shall be responsible for every such lamp being kept properly and sufficiently lighted and trimmed. 15.—That the rate of speed at which all tramcars ; shall travel or be propelled on the said tramway j shall be not less than four a.nd a-half miles per hour and shall in no case exceed a maximum rate of ten miles per hour, and round street corners and in crowded thoroughfares shall travel only at a reasonable speed such as the circumstances of the case may require.
