ACTION FOR LIBEL AGAINST THE PALL MALL GAZETTE.
This is an action brought by Mr. Frederick Ginnett, a circus proprietor, for a libel published in the Pall Mall Gazette on March 2S, ISSS, and which was contained in a letter addressed by Mr. Whittingham, an Oxford undergraduate, to the effect that a friend of his had visited the circus, which was at that time in the city, and ascertained that the grossest cruelty was practised in training the young acrobats. The defendant denied that the matter complained of was published with actual malice or negligence, and alleged that before action an apology had been made and he had paid £5 into court in satisfaction of the plaintiff's claim. Mr. Ginnett, Mr. Norton (the plaintiff's manager), and Mr. Claude Ginnet, were called, and emphatically denied that there was any ground for the charges contained in the.letter. Mr. Crump, without calling any witnesses, addressed the jury for the defence, and Baron Huddleston having summed up, the jury found a verdict for the plaintiff for £1500 beyond the £5 paid into court.
