A DISHONOURED CHEQUE.
[BY TELEGRAPH.—OWN CORRESPONDENT.'! Christchurch, Tuesday. A VKBY.singular case was before the Resident Magistrate yesterday. A publican, named Allen, found among his dead wife's papers a cheque, dated December 17, last year, for £46 63, signed by one Lockwood, and endorsed with two names. This cheque, he discovered, had been dishonoured on presentation, as Lockwood had told his bankers not to pay it. Allen, as executor for his wife, now sued Lockwood for the £46. A barmaid said she knew Mrs. Allen on two occasions had lent defendant a £5 note, and a cabman said he had known him to borrow money of her. Lockwood, in defence, said lie had been on the spree, and Mrs. Allen joking with him about wanting money, he had said, "How much do you want?" and she replid, " £40 or £50-" He then wrote the cheque, for which he had received no consideration. His wife said she had come Tip to Christchurch to hunt up her husband, and found him drinking at plaintiff's hotel. Lockwood asked Mrs. Allen how much he owed her, and paid her in the wife's presence. The Bench said they could not give plaintiff a verdict, for they believed Lockwood did sot know what he was about at the time, and there was no evidence of sufficient consideration as having been given for the cheque.
