Notice is hereby given that the following By-Law made by the Auckland Harbour Board will come Into force, and be in opention, on and alter TUESDAY, the Ist day of Jn)y, 1879. D. H. McKENZIE, Chairman. BY-LAW OF THE AUCKLAND HARBOUR BOARD. The Auckland Harbour Board under and is pursuance of the powers in that behalf rested in them by " The Harbours Act, 1878," do hereby make and pass for and within the limits of the Harbour of Auckland the By-law following, that is to say :— PILOTAGE R4.TE9. 1. The matter of every vessel not exempt from Pilot Fees, shall pay for Pilot Fees as follows :— s. d: For every s.iling vessel from places outside of Hauraki Gulf, for every ton .. .. 0 3 For every sailing vessel to places outside of Itruirjki Gulf, for every ton .. .. 0 3 For eveiy ste.tm vessel from places outsido of Hauraki Gulf, for every ton .. .. 0 2 For evt-ry steam vessel to places outside of Hauraki Gulf, for every ton .. .. 0 2 PORT CHARGES. 2. The master of every vessel over 15 tons register, whether coniiLg from seaward or not, whether decked ur undecked, whether propelled by steam or nut, navigating or plying for hue or not within the Port, shall pay as Port Cr-nrges in respect of such veisel one penny per ton on arrival in Port: Provided alwajs that payments in respect uf such vesat-1 havlug been made tqml in the aggregate to a turn of fourpeuce per ton half-yearly ; half-years to count, from January 1 and July lin each year; (■uch vessel shall not bo liable for any further or other sum for such half-year. HA.RBOUE-MASTER'3 FEES. 3. For every Bervieo performed by a Harbourmaster for any person in respect of any ship such peison shall pay for tucu seivice as follows, that is to aay :— For all vessels under 120 tons, 10s ; for every ton exceeding 120 ton.-, three farthings. SHIPPIXG WHARFAGE. 4. It shall not be lawful for any person to ship or unship, load or discharge, any goods into, out of, or from any vessel except at such wharves as are now or -hall hereafter from time to lime be declared Public Wharves and Landing tlacej, without a spucial permit from the Board. Every person who shall use any wharf with any vessel shall p-;y for the use thereof as follows (Sundays excepted). That is to say :— 1. For every licensed ferry steamer, £i per quarter; for wharves on the South Shore of Auckland Harbour, for wharves on th» North Shore of Auckland Harbour, £i per quarter. 2. For every steam vessel plying within the harbour above Kauri Point, one-ha f the dues named in last before-written sub-clause. 3. For every vessel, not Included in subclauses 1 and 2, under 20 tons, 10s for every quarter ; over 20 and not exceeding 30 ton.", 15s for every quarter ; over 30 and not exceeding 40 tons, 20s per quarter; and all the beforenamed payments shall be payable, anil be made in advance, on the qmrter-days commencing as from Ist day of Januaiy, April, July, and Octo-er iu each year, at the otlice of the Auckland Harbour Hoard. 4. For every vessel not included in sub-clauses 1, 2, and 3, one farthiog per ton on gross register per day or part of a day. 5. For every vessel occupying a berth outside another vessel, lording or discharging cargo, one-eighth of a penny per ton on the gross register for every day or part of a day. GRIDIRON FEES. fi. Every person who shall use with a vessel any gridiron provided by the said Board shall pay for the use thereof as follows. That is to say:— For every vessel under 3l> tons, 6s day or part of a day; over SO tons and not exceeding 50 tons, 103 per day or part of a day ; Bnd for every additional 59 tons or fraction of 50 tons over 50 ton?, 5s per day or-part of a day, such payment to be calculated on tho gross tonnage of every vessel.
CRANE DUES. G. Every person who shall uso any crane provldod by the said Board shall lay far tho use thereof as follows, lhat is to say :— i. d. For all -weights of two tons and upwards lifted within the hour 10 0 For each hour or portion of an hour the crane is employed as above, alter the first hour 5 0 For loading cr discharging genera! cargo, for every hi-ur or portion of an hour.. .. 10 For single package*, if not more than 1 ton w.ight 10 For single packages over 1 ton, II not more then 2 tons weight * .. 2 0 For horses, or oiher largo cattle landed by such crane, each .. .. .. .. 10 FENDER DTJE3. 7. Every person who shall use any fender provided by tho said Board shall pay for the use thereof as ollows. That Is to say :— For the use of any fender at any wharf, pier, or jetty, there shall bo pud one shilling per day, or part of a day, for each fender. Any fender lost when taken into use and boforo zetura to the taid B„ard shad be paid for by th* masters or owners (at the option of the said Board). GOODS WHARFAGfc. 8. Every person who shall land any goods on any wharf under the control of the said Board, or shall nse <ucu wharf to ship any goods shall pay, as wharf dues thereon, as follows. That is to say : — 1. For all goods (except such as aro hereinafter provided for) landed on any whatf, a rate of 2s per ton, weight or measurement, at the option of the caid Board. 2. For all goods (except such as are hereinafter provided for) .'hipped from any **h*rf for export uut of tho colony, a rate of Is per ton, weight or mcaßurem' nt, at tho option of the said Board, provided lhat all goods which have paid inwards wharfage thall not be charged wiih export wharfage. 3. For all goods landed or passed over any wharf, or for the landing or shipping of which a wharf shall b: used (one payment being sullicicnt for one or both operations) as follows :— ». d. If any goods so remaia without the consent of the Harbour Hoard, any person appointed by the Hoard for that purpose may r< move tho same to any of the premises of the Board or other Co venient p ace, and beep tho eamo until payment to tho Board of tho expenses of such removal and of the keeping of the goods ; and, if BUh exponso. be not paid within sovon days after demand thereof made upon the owner, or if such owner cannot be found, or shall be unknown, then, after the Board shull have given public notice by advertisement at least once iu each of three consecutive weeka in Bomc newspaper circulating at tho port where such goodi aro, the Board may sell such goods byj.ubl o auction, and out of tho proceeds of such sale pay all duo- and charges payabio thereon and the expenses of romoval and of tho sale thereof, and the surplus (if any) shall bo rendered to tue owner on demand. If the owner of tho KOOds cannot be found, or be unknown, then tho surplus ehall be paid into the I'nbJic Account of tho i olony, and shall go to and form part of tho Trust Fund, and bo dealt with accordingly. It shall not bo lawful to remove any goods from any wharf until all entries are passed and all dues paid at the office of the said Hoard, and no good* will be permitted to be removed from any warehouse, wharf, or other place wbera the same may have been landed, stored or dischargee, until a receipt or other authority he produced from tho taid Board, or by seme officer or rervant of the Board authorised for that purpose shewing tbo payment or satiafact on of all dues lawfully levied by the Board, and no goods shall be shipped from any wharf, or other place until all dues shall have been paid upon such goods. It shall be lawful for the "Collector, either alone o r with other persons, to enter any vessel in order to ascertain the dues payable in respect of the vessel or of goods therein : and it shall not bo lawful for any person to bJnder*oz molest any Collector, or refuse to allow any Collector to enter into any reesel.
