OTAHUHU R.M. COURT.—Tuesday.
[Before It. C. Barstow, f'sq., K.M.J Thomas Sutliff was charged by John Carnall with assaulting him ut the Flat Bush, thereby tending to provoke a breach of the peace. A counter charge was made against Carnall. Mr. Joy appeared for Sutliff, and Mr. Keetly for Caruall. After hearing a good deal of conflicting evidence, aud a display of forensic wisdom, the counsel for the plaintiff proposed to withdravv'the cases, with the consent of the Court, which, was readily assented to by Mr. Joy, cach party to pay their own costs. The Bench allowed the cases to be withdrawn, and admonished the young gentlemen to exercise their energies in a more worthy and profitable way. civil cases. Hogan v. Monaguan*.—Claim £1 163, for grazing a cow, at 3s a-week. £1 4a bad beeu paid into Court. Judgment fur the £1 4s, plaintiff to pay 503 6d cost*. Taylor v. Glew.—Claim 7s fid, balance of wages. Plaintiff deposed that au agreement was made to give his little girl 2s 6d a-day. The defendant denied this in toto, and said that, although he always paid the highest wages in the Tamaki, he was only only paying 2s a-day to his best handd, but the little girl was not one of them. After examining the time-books kept by both parties, His Worship gave judgment for the defendant, but without co3ts. Djs Rose v. George Robinsox. —This was a judgment summons case. Tha defendant had been ordered to pay the account by instalments, but he had failed to do so. The Bench said that if he did uot piy tho instalment due by next Court-da}', he would most certainly go to gaol.
