Assault. —Werahiko, (a native), of Ngatauiwi, of Waiheki, was brought up on remund, charged on the information of Mr. Francis, barman of the Waitemata Hotel, 'with haying..assaulted George _ Keene, by knocking him down, thereby breaking his left leg.— Prisoner pleader! guilty.—Mr. Kaughton said BOn3o ovidence would havo to be adduced as to tllo nature of the injuries, and then it would be competent with the Bench to proceed with the case.—The Bench were of opinion that the case might be proceeded with. —Dr. Nicholson deposed to having been called to attend George Kecne at the "Waitemata Hotel, he found that ono of hiß legs was broken, while tho shin of the other was grazed. was likely to be six or ciiiht weeks under niedic-1 treatment. There was, "however, no danger to life. — Mr. Hector, who officiated as interpreter, communicated tho purport of the foregoing evidence to the prisoner, who declined to cross-examine Mr. Naughton said as the case "was a very serious one, he would ask the Bench to exercise their powers under the 71st section of tho Justices of the Peace Act, by imposing a fine, and awarding part of it to the sufferer Keene.—The Bench ordered the prisoner to pay a fine of £10 and expenses, or to undergo two months* imprieonment with hard labor. Tho interpreter having communicated the sentence to the prisoner; tho latter was allowed to retire for the purpose of consulting his friends as to the course to be adopted. Non-Payment .of Rates —In the following cases of non-payment of City rates, Mr. Wynn appeared fcr the City Board, and the respective sums were ordered to be paid:—T. Mack, £4 3s 4d, house in Albert-street. —It. F. Barker, £1 2s 6d, on a wood building in Ohapel-street.—Thomaß Pink, £L 10s 9, Property in Newtown.—J. B. Hannaford, £1 13s, property in Nelson-street.—J. Dunning, £2 10a, property" in Qrey-street.—F. O'Brien, £5 8e 4d, Short-land-street. — ff. J. "Wadham, £3 Is 6d, house in Nelson-street, no appearance of defendants. Defended Oases.—Hardington and Brown; claim £26 15s 6d. —Mr. Wynn appeared for th-3 Collector; Mr. Brookfield for the defence.—Mr. "Wynn applied for a remnnd as Mr. Brown was not in attendance. The defendants were jointly liable, and therefore the case could not proceed without their attendance. — Mr. Brook Geld applied for costs. He appeared on behalf of the defendant Hardington, and waß prepared to proceed.—The Bench declined to allow costs, hut directed Mr. Wynn to secure the attendance of tho other defendant. The case was adjourned until Tuesday next.—P. Harkins, £2|ls 8d; property in Hobson-street. —Mr. Hill appeared on behalf of the defendant, who produced the leass under which he held the promises upon which the assessment was levied, and deposed that at the period for which tho rate waß struck he was not in occupation of the premises. He had paid rates for subsequent periods. I Hr. Bill submitted that the rate should have been levied upon the occupier under the 39th clause of the Act, Mr. "Wynn in reply said it made no difference, as in default of payment by the ocoupier the owner was ultimately liable.—The Bench said, that when a person went into possession of premises he should take caro that the rates had been paid. There was no alternative but tolgive judgment for plaintiff.
