DBUUKEXiiESS. ■John Lc Foley and Mary Kearns were convicted of tins offence and ordered eacli to pay a fine of 20s and the costs, or in default to be imprisoned for -IS hours witli linrd labour. Mary Kcarns received seven days additional tliis being her third offence. OBSCENE I.ISGCAGE. Bridget Hawkey pleaded not guilty to a breach of the '18th sub-section of the 3rd section of the Auckland Municipal Policc Act, by using obscene language in Chancery-street. The offence having been proved she was fined £10, or in default to be imprisoned lor two months. EMBEZZLEMENT. •Tesse Cole was brought up on this charge. Mr. -Maedonald on behalf of the prosecutor asked for a remand in consequence of the absence of a material witness. Mr. TYynn (on behalf of the prisoner) objected, on the ground that no information had been laid against the prisoner. His Worship inquired the facts of the case from Mr. Commissioner jNaughton, -who was in attendance. Mr. Commissioner Nuughton said the informant had come to the Police office on Monday, to lay an information against the prisoner. He (the Commissioner) had cautioned the informant to be careful as the matter was very serious, but as he persisted in having the prisoner taken into custody he was directed to sign the cliargcbook, and to be in attendance for the purpose of laying the information previously to the sitting of the Court. The prisoner was then removed while the information was being laid, and afterwards brought again into Court, and charged with having on the 22nd day of April, then being servant to one Henry Wadham (the prosecutor), did receive and take into his possession for and on account of his said master, the sum of £1 8s in money, on the 11th day of Uccember, 18G6, and the further sum of £1 3s. lOd. in money on the 23rd Jan., 1807, and the same feloniously and fraudid embezzle, &c. The prisoner was then remanded until Friday next, bail being allowed in two sureties of £25 each, and himself in £50. This concluded the business.
