If such Inspector shall be satisfied that such Cattle are free from infectious disease and | were not imported from any District where | . infectious disease shall be known to prevail i he shall give to the Master of such ship or I vessel a certificate to the effect after which ' certificate so obtained but not before such i Cuttle may be lauded. Penalty for lauding Cattle. VIII. Every Master of a sliip Or vessel irlio shall land or sutler to be landed any Cattle without having obtained such Ccrtitieite as aforesaid or shall rofusc : or neglect to destroy Cattle according to any such . notice as aforesaid or shall otherwise oilbnd against I i the provisions of this Act hereinbefore contained shall ! ] forfeit and pay any sum not exceeding £500. . j Governor t<l declare prohibited Ports. : j IX. If at any time it shall be made to appear to ■ the Governor that any infectious or contagious disease j i has broken out in any district out of the Colony it , shall be lawful for the Governor by Order in Council t ; to declare that sucli district is infected within the * \ meaning of this Act and from time to time to make ; such Regulations lis to him shall s"em fit for pro- ; hi biting the importation of Cattle into the Colony | from such district and the landing or driving of snch I Cattle and for deslroving tbattle imported landed or j driven contrary to sucli Regulations. ! Infected Cattle in the Colony may be destroyed. j X. If at any time it shall be made to appear to the Governor that any infectious or contagious disease has broke out amongst Cattle in any district of the colony it shall be lawful for the Governor by Order in Couueil to declare that such district is infected t within the meaning of this Act and from time to time to make such regulations for destroying Diseased .. Cattle therein and for prohibiting the removal or | transportation of Cattle from one part of the Coluny , to another and lor preventing the further spread of ' such disease as to him skill seem fit. Itcgiilations and npp.'.ntments lo be published. XI. All regulations made hv the Governor under authority of tin's Act shall be published in the General Government Gazette, and all regulations and appointments made by the Superintendent- of any Province in pursuance of any power delegated to him under the power of delegation hereinafter contained shall be published in the Governmtnl Gazette of such Province and all such regulations being so published shall have the the force of law. I'enalty for breach of regulations. XII. Any person guilty of any broach of such 1 regulations as aioresaid shall be liable to such penalty as shall be expressed in such regulations not exceeding £500. Penalties how recoverable. XIII. Penalties under this Act or under the regulations authorised by this Act may ho recovered in a summary way before any Resident. Magistrate or any two Justices of the Peace for the use of ller Majesty by any person who may sue for the same. Governor may delegate powers lo Superintendents. XIV. Ihe Governor in Council may bv warrant under_ bis hand from time to time delegate to the Superintendent of any Province within the said Colony all or any of the powers vested in the Governor or the Governor in Council by this Act subject lo such regulations as ho may think lit and may fi'om time to time rescind sucli delegation. Interpretation. • J" the Interpretation of this Act the word " Cattle" shall mean and include Xcat Cattle whether living or dead and parts of such Cattle The word " District " shall as regards the Australian Colonies s* mean and include the entirety of the Colony and all Colonies and extra Colonial places iinuicdiatelv adjacent thereto the words " infectious disease" or " contagious disease " throughout this Act sliall mean and include the disease called Pleuro-pneunionia and every other disease commonly reputed to be conII tagious or infectious. v Indemnity lo Superintendent of Cauterbun/. XVI. And whereas an Ordinance was lately passed or purported to have been passed by the ISupcrm--0 Undent and Provincial Council of the Province of Canterbury for prohibiting the importation of diseased Cattle but before the passing thereof the said Council was dissolved and the said Ordinance lws t been expressly disallowed by the Governor And n whereas Acts may havo been done or authorised or o permitted to be done by the Superintendent of the 11 said Province under the powers of the said Ordinance r before receiving notice of the disallowance of such Ordinance Be it enacted by tho General Assembly of Xew Zealand and by tho authority aforesaid that the said Superintendent shall be and lie is hereby relutscd and indemnified from and against all actious suits 1- claims and demands whatsoever by reason or on. e account of any Act matter or thing done authorised or permitted by him according to the provisions of the said Ordinance before receiving notice of the disallowance of such Ordinance.
