And whereas, by a wan-ant under tho hand of His Excellency the Governor, bearing date tho fifteenth day of .September, 18Go, the said Governor, with the advice and consent of the Executive Council, delegated to the .Superintendent of the Province of i Auckland, certain powdrs conferred upon liim by the ! " Diseased Cattle Act, ISGI," subject to certain regu- j lations to be made by tho Governor in Council under j the said recited Act. j Now, therefore) I ; Robert Graham, Esquire, Su | perintendent of the Province of Auckland, in pur- | suanee of shell delegation, do hereby proclaim and ] declare that from and alter the day of the date hereof, I that part of the Province of Auckland lying South j of a line running West from the Whan Bridge to the j sea shall lie and be deemed io be an Infected Dis- ' triet, within the meaning of the " Diseased Cattle I Act, ISGI." I liEGITLAT lONS. , No person shall drive, or permit to be driven, ! any tattle infected or otherwise, over or along ; any public road or highway in any dis- j triet proclaimed under the said Act, unless he shall have first obtained a certificate under j the hand of some Inspector appointed under the said ■ Act, certifying that such cattle are not infeeted. j Every such certificate shall describe the cattle therein ! referred to with a reasonable degree of certainty: Provided that such certificate shall only remain in j force for a period not exceeding 24 hours. : Any person who shall knowingly or wilfully drive j over or along anv load or highway which may be in- . feclod with any infectious or contagious disease, shall • be liable to a penalty not exceeding £000, ! Any person who shall knowingly keep in his pos- : session or on his premises any cattle so infeeted and shall nut give notice to some Inspector appointed : luider tho said Act, shall forfeit and pay any sum not ; exceeding .t'.'illO. It shall be lawful for any inspector appointed under the said Act to enter upon all -or any lands in ! any district which may have been declared to be ail infected district in pursuance of tho f aid Act, for the purpose of inspecting any cattle which may bo on such lands ; and if any such inspector shall find any cattle oil such lands infected as aforesaid, it shall be iawtul for him to take such steps as to him shall seem tit for destroying such cattle and burying tho carcases thereof: Provided that 110 sucli. Inspector shall bo liable for any damage that may arise to the owner of any cattle so destroyed, if such Inspector has proceeded without malice, and in the bona fde discharge of his dntv. AN ACT TO PREVENT TIIE IMPORTATION OF DISEASED CATTLE. [sth SEl'TKjrßEll, 1861.] EE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and bv tho authority of the same as follows : — Short Title. I. The Short Title of this Act shall be " Tho Deceased Cuttle Act ISGI." Governor to appoint Inspectors. IT. The Governor shall from time to time appoint ; proper persons at such ports and places as to liim shall seem tit to be Inspectors of Deceased Cattle to perform the duties required by this Act and may from time to time remove sucli pel-sons and appoint other persons in their respective places. To be Xotificd. 111.
