A CLARIFICATION

There are two details which may not have been made clear in the report of the case against Maxwell Herbert Eaton at the Kaitaia Courthouse on Monday : Firstly While declining to call the doctor as a witness, the prosecution had made it clear to the Court that the medical report of the examination of the defendant, one hour after he was arrested by the Traffic Inspector, had been made available to the defendant’s counsel and could be used in evidence ; and secondly—though he declined to answer the prosecutor’s direct question regarding the defendant’s condition one hour prior to the examination, the doctor did state that, providing he had had no liquor during the intervening period, the defendant would have been in a worse condition.
