CLAIM FOR DAMAGES

FITTER INJURED BY 7 REVOLVING PROPELLER Wellington, This Day. In the Supreme Court. William Laurence Jackson, fitter, who was injured through being struck by a revolving propeller at the de Haviffand factory is seeking £3201 3s damages, alleging negligence on the part of the company or some of its servants in failing to provide a barrier or warning notice at the shed where the engine was running on test. The defence alleges that plaintiff had no business to enter the shed, his duties not requiring him to be in or near the test house. A further defence is that plaintiff ignored the warning given by the great noise of the engine and the violent current of air from the propeller, also negligence on the plaintiff's part in not taking reasonable precautions for his own safety, and that he voluntarily incurred risk of injury. Argument on a non-suit point was hea *d yesterday afternoon, and the hearing Avill be resumed this morning before Mr Justice Smith and a jury.— P.A.
