This undertaking went under the name of McMasters Toy Supoly and defendant signed correspondence as "Neil McMasters.” At the time of Detective-Sergeant Murray’s visit he communicated with his solicitor and was told that he must discontinue the use of this name.

“This is merely a technical offence. All sorts of businesses are run under assumed or fictitious names,” said Mr Tizard, for the defence. He submitted also that in the present case the name “McMasters” was used merely for the purposes of building up goodwill. If defendant. had adopted the simple process of writing “P.P.” and his own signature after the name “Neil McMasters.” he could not have been charged
