INJURY TO COLT MALA
OWNER CLAIMS £2OOO DAMAGES v , (United Press AsHociation—Hy Electric Telegraph—Copyright;. SYDNEY, 21st June. Henry Edgar Russell, owner and trainer of the colt Mala, began an ’ action in the Supreme Court to-day against the Commissioner of Road Transport and Tramways to recover £2OOO damages owing to injuries to Mala, when the horse was struck by a tram on the morning of the last A.J.C. Derby, 3rd October. Mr J. Cassidy, who is appearing for Russell, claimed that Mala injured a fetlock and legs, as a result of which his chances of winning, the A.J.C. Derby, subsequent Sydney and Melbourne classic events, and, also.. the Great Northern Derby in New Zealand were seriously prejudiced. This mishap, Mr Cassidy contended, was primarily due to the excessive speed of the tram. The case is part heard. Mala was struck by a tram' at Randwick tnd finished second to Talking in the Derby. Russell gave evidence that he was sure he was going to saddle a Derby winner with Mala, but the accident upset, him and made the difference between a win and a loss, and the following- day the colt walked short in the front leg as well as in the hind leg. , ‘ WRONG HANDICAP? AUCKLAND, 2lst JMne. An; objection to the first prize in the Mangere Handicap at the Auckland Club’s Winter Meeting on Saturday being paid to the winner, "harteris Bay, has been lodged by Mr A. E. Commons, stipendiary steward, on the grounds that the horse was wrongly handicapped in being on the 3min 40sec mark. The judicial committee of the Auckland Trotting Club has referred the matter to the New Zealand Trotting Association.
