MAGISTRATE’S COURT

At the Magistrate’s Court to-day, before Mr T. E. Mauusell, S.M., R. W. R. Sliand (Mi* S. 11. Moynagh) pleaded guilty to striking an oncoming car on the side when driving out of town. Mr Moynagh said if was just an error of judgment. The defendant was fined £1 and 16s costs. Harold M. White, who did not appear, was charged with riding a motor cycle without a license. “He is quite an irresponsible youth,” said the Senior-Sergeant. White was fined £1 and 12s costs. Roland H. Winstauley was fined 5s and 10s costs for setting off fireworks in Trafalgar street on New Year’s Eve. The Senior-Sergeant said that they had had an instance of “one silly young fool” throwing a cracker on a young lady’s hat. Robert Sinclair pleaded guilty to sending a youth under the age of 21 years to procure liquor. He was fined £1 and costs 10s. Edward S. R. Small, barman at the Trafalgar Hotel, was charged with supplying liquor to a person under the age of' 21. Small said .the youth had told him he was 21. The Senior-Sergeant said there had * been warnings about serving liquor to youths. The Magistrate remarked that it was no excuse if the defendant had been told a lie. The responsibility \Yas on him. He was under no obligation to serve liquor if lie, was in doubt. The Senior-Sergeant said that this was the fourth case which had come before the Court. Apparently the licensees and barmen were disregarding the law. ■Small was fined £3 and 10s costs William J. Kyle, licensee of the Trafalgar Hotel, pleaded not guilty at first to a charge arising out of the - same incident, but changed it to a plea of guilty. The Magistrate pointed out that the defendant was liable for the acts of his servants. If a 'lie was told it was his misfortune. Kyle was ordered to pay 10s costs. Frederick Shelley was’ charged that having received certain sums of money amounting to £l2 7s 7d on terms requiring him to account for or to pay the same to the Colonial Mutual Life Assurance Company, he did fraudulently omit to account for or pay ,the same and did thereby commit theft. Ho was remanded to appear in Wanganui.
