GARDEN ASSAULT CASE
ALLEGED CONSPIRACY APPEALS DISMISSED (United • Press Association—Dy Electric Telegraph—Copyright) SYDNEY, 15th June. The first of the appeals by eight men convicted of assaulting J. Garden on 6th- May was heard before Mr Justice Curlewis to-day. Counsel sought to show that there was a conspiracy on the part of certain people to cause the assault on Garden for political motives, involving the New Guard. The Judge dismissed the appeal, saying: “I am sorry I cannot increase the sentence of three months already imposed.” Three other appeals were later dismissed, /and the remaining four adjourned till to-morrow.
Mr Teese (counsel) caused a sensation by remarking: “I am retiring from the case. I cannot see any use in remaining as junior counsel.” Mr Owen remained in the other appeals not yet heard.
