SOUTHLAND ASSIZES.
[United Peess Association.] INVERCARGILL, Monday. At the Supreme Court to-day Henry Albert Nicholson sued James Baird, fiax. miller, for £44 3s 3d, damages alleged to have been sustained through the failure of defendant to comply with conditions of contract for the supply and delivery of flax by defendant to plaintiff. Judgment was given for £96 13s 3d. On a counter claim for £459-95.10 d none the items was held as proved save one in which D. L. Baird claimed a sum fcr indemnity on account of plaintiff iiivng compromised his action by settling with one of the defendant's contractors, j.nd on this item judgment was veservtd.
